Welcome to Pitchpigment. By purchasing or using our products and services, you agree to these terms.

1. Intellectual Property & Copyright Protection

All designs, artwork, digital files, photographs, and creative content created and sold by Pitchpigment are protected by Canadian and international copyright laws.

• Original Designs: All SVG files, PNG images, clipart, illustrations, and custom designs are the exclusive intellectual property of Pitchpigment.
• Unauthorized Use Prohibited: You may NOT copy, reproduce, redistribute, resell, or claim our designs as your own.
• No Trademark Use: Our brand name "Pitchpigment" and logo are trademarked and may not be used without written permission.

2. License Types for Digital Products

Personal Use License (Standard):

• Create physical items for yourself, friends, and family (non-commercial)
• Not for resale or commercial purposes
• Limited to personal projects only

Commercial License:

• Create and sell physical products using our designs
• Maximum 500 physical items per design
• You may NOT resell, share, or redistribute the digital files themselves
• You may NOT use designs for print-on-demand services (Printful, Printify, etc.)
• Credit to Pitchpigment is appreciated but not required

Prohibited for ALL Licenses:

• Reselling or sharing our digital files (SVG, PNG, etc.)
• Uploading to sharing platforms (Creative Fabrica, Design Bundles, Etsy as a digital download, etc.)
• Creating new digital products from our designs to sell
• Claiming designs as your own work
• Using AI to modify and resell our designs

3. Platform-Specific Compliance

Etsy Sellers:

• You may sell physical products made with our commercial license designs
• You may NOT resell our digital files on Etsy
• Follow Etsy's intellectual property policies

Pinterest Users:

• You may pin images of finished products you've created
• Do not share or distribute our digital files via Pinterest
• Respect Pinterest's copyright and intellectual property guidelines

Creative Fabrica & Similar Platforms:

• Our designs may NOT be uploaded, resold, or redistributed on Creative Fabrica, Design Bundles, or similar marketplaces
• This violates our copyright and will result in legal action

4. Custom Orders & Physical Products

• Custom orders are final once production begins
• You own the physical product, not the design rights
• Turnaround time: 5-10 business days unless otherwise specified
• Rush orders available for an additional fee

5. Product Photography Services

• You receive usage rights for marketing and commercial purposes
• Pitchpigment retains copyright to all photographs
• We may use photos in our portfolio unless you request otherwise
• You may NOT resell our photography services or photos to third parties

6. Stock Photos Policy

License Grant:

• When you purchase stock photos from Pitchpigment, you receive a non-exclusive, royalty-free license to use the images
• License is valid worldwide and perpetual (no expiration)
• You may use photos for commercial and personal projects

Permitted Uses:

• Marketing materials (websites, social media, advertisements, brochures, flyers)
• E-commerce product listings (Etsy, Amazon, Shopify, etc.)
• Blog posts, articles, and editorial content
• Printed materials (business cards, posters, packaging)
• Digital and physical presentations
• Social media posts and advertisements (Facebook, Instagram, Pinterest, TikTok)

Prohibited Uses:

• Reselling or Redistribution: You may NOT resell, share, sublicense, or redistribute our stock photos in any form
• Stock Photo Platforms: You may NOT upload our photos to stock photo websites (Shutterstock, Adobe Stock, Unsplash, etc.)
• Print-on-Demand: You may NOT use photos as the primary design element on products for sale (t-shirts, mugs, posters, etc.)
• Templates & Digital Products: You may NOT include our photos in templates, themes, or digital products you sell
• Standalone Sale: Photos cannot be sold as standalone digital downloads
• Offensive Use: Photos may not be used in defamatory, pornographic, or illegal content
• Trademark/Logo: Photos cannot be used as part of a trademark or logo

Attribution:

• Attribution to Pitchpigment is appreciated but NOT required
• If you choose to credit, use: "Photo by Pitchpigment" or link to pitchpigment.ca

Modifications:

• You may edit, crop, resize, and adjust colors of purchased photos
• You may add text, graphics, or other elements to photos
• Modified photos are still subject to the same usage restrictions

Copyright & Ownership:

• Pitchpigment retains full copyright and ownership of all stock photos
• Purchasing a license does NOT transfer copyright to you
• We reserve the right to license the same photos to other customers
• Photos may appear in our portfolio and marketing materials

Model & Property Releases:

• Product photos do not typically require model releases
• If photos include identifiable people or private property, releases are obtained
• Contact us if you need specific release documentation for your project

Extended License:

If you need rights beyond the standard license (e.g., exclusive use, unlimited print runs, merchandise), contact us for an Extended Commercial License at an additional fee.

Violation of Stock Photo License:

• Unauthorized redistribution or resale will result in immediate license termination
• We will pursue legal action and seek damages for copyright infringement
• Violators will be reported to platforms where violations occur

7. Copyright Infringement & Legal Action

We take intellectual property theft seriously. If you violate these terms:

• We will issue a cease and desist notice
• We will report violations to relevant platforms (Etsy, Creative Fabrica, etc.)
• We reserve the right to pursue legal action and seek damages
• All licenses will be immediately revoked

7. Limitation of Liability

• Digital files are provided "as is"
• We are not responsible for user error, incompatible software, or cutting machine issues
• Physical products are made with care, but slight variations may occur

8. Modifications to Terms

We reserve the right to update these terms at any time. Continued use of our products constitutes acceptance of updated terms.

Refund & Cancellation Policy

Digital Products (SVG, PNG, Clipart, Illustrations)

No Refunds on Digital Downloads:

• Due to the nature of digital products, all sales are final once files are downloaded
• Please ensure you have the necessary software and skills before purchasing
• Preview images are provided to help you make informed decisions

Exceptions:

• Files are corrupted and cannot be opened (we will resend working files)
• Wrong files were delivered (we will send correct files immediately)
• Duplicate purchase made by error (refund within 24 hours before download)

Technical Support:

• We provide support for file access issues
• We do NOT provide tutorials on how to use cutting machines or design software
• Contact us within 7 days of purchase for file-related issues

Physical Products (Custom Items, Sublimation, Vinyl, Laser Engraving)

Cancellations:

• You may cancel within 24 hours of placing your order for a full refund
• After 24 hours, if production has started, cancellations incur a 25% restocking fee
• Orders cannot be cancelled once shipped

Returns & Refunds:

• Defective or damaged items: Full refund or replacement within 7 days of delivery
• Items must be unused and in original condition
• Customer must provide photo evidence of defect/damage
• Return shipping costs are the customer's responsibility unless item is defective

No Returns/Refunds for:

• Custom/personalized orders (unless defective)
• Change of mind or buyer's remorse
• Color variations due to screen settings
• Minor imperfections inherent to handmade items

Product Photography Services

• Cancellations: 50% refund if cancelled 48+ hours before session; no refund within 48 hours
• Rescheduling: Free rescheduling with 48 hours notice; $50 fee within 48 hours
• Satisfaction: Minor edits included; major revisions subject to additional fees
• No Refunds: Once photos are delivered, sales are final

Shipping Issues (Physical Products)

• Lost packages: Contact us within 30 days; we'll work with carrier to resolve
• Damaged in shipping: We'll replace or refund if reported within 7 days of delivery
• Wrong address: Customer responsible for re-shipping costs if address was entered incorrectly

2. How We Use Your Information

• Process and fulfill your orders
• Send invoices and payment confirmations via Wave
• Communicate about your orders via WhatsApp or email
• Provide customer support
• Improve our products and services
• Send promotional emails (only with your consent - you can opt out anytime)
• Comply with legal obligations

3. Information Sharing & Third Parties

We do NOT sell your personal information. We only share data with:

• Payment Processor: Wave (for secure payment processing)
• Shipping Carriers: Canada Post or other carriers (name and address only)
• Platform Partners: Etsy, Facebook, Instagram, Pinterest (when you interact with us there)
• Legal Authorities: If required by law or to protect our rights

Social Media Platforms:

• When you visit our Etsy, Facebook, Instagram, Pinterest, or TikTok pages, those platforms' privacy policies apply
• We may use platform analytics to understand customer interests
• We do not have access to your passwords or sensitive platform data

4. Data Security

• We use industry-standard security measures to protect your data
• Payment information is encrypted and processed through Wave's secure system
• We do NOT store credit card details on our servers
• Regular backups and security updates are performed

5. Your Rights

You have the right to:

• Access: Request a copy of your personal data
• Correction: Update or correct inaccurate information
• Deletion: Request deletion of your data (subject to legal retention requirements)
• Opt-Out: Unsubscribe from marketing emails at any time
